General Terms

These Terms of Service govern access to and use of myrealtorti.digital and the delivery of legal services by myrealtorti to corporate clients. By using our platform or engaging our services you accept these terms. We provide legal advisory and support services tailored to business needs; contractual details for specific engagements are set out in client agreements.

Eligibility

Services are available to businesses, corporate officers, and authorized representatives who can lawfully enter into contracts under Thai law. You must provide accurate information and have authority to bind the entity on whose behalf you act.

Users must be of legal age to enter into contracts in their jurisdiction and authorized to submit information on behalf of a business or corporate entity. myrealtorti does not provide services to individuals lacking contractual capacity.

You agree to use myrealtorti services and resources only for lawful purposes and not for any activity that would contravene applicable Thai law or international regulations. Prohibited uses include fraud, funds laundering, and activities intended to infringe the rights of others.

Certain services or advice may be limited by local regulation. myrealtorti operates primarily in Thailand and services outside Thailand may be subject to jurisdictional restrictions. It is your responsibility to comply with local laws where your business operates.

Account and Access

Access to client portals and certain service features requires an account. You are responsible for maintaining accurate account information and securing login credentials.

You certify that information provided to create or maintain an account is accurate and up to date. Notify us promptly of any changes to avoid disruptions to service delivery.

Maintain confidentiality of your account access credentials. Notify myrealtorti immediately if you suspect unauthorized access. We will take reasonable measures to protect account security but are not liable for losses resulting from compromised credentials where you have failed to safeguard them.

Accounts are non-transferable and may be used only by the registered entity or authorized representatives. Transfer of accounts requires written approval from myrealtorti.

If you believe your account has been compromised, notify our support team immediately at [email protected] so we can contribute and take appropriate protective steps.

We may suspend or restrict account access where required by law, for security reasons, or for breach of these terms. Suspension will be communicated with reasons and duration when feasible.

Scope of Services

myrealtorti provides corporate legal services including company formation, contract drafting, compliance audits, employment law advisory, dispute avoidance strategies and regulatory guidance tailored to Thailand. Specific scope and deliverables are described in written engagement agreements.

We may update service offerings, procedures, or technology used to deliver services. Changes affecting ongoing engagements will be communicated and may require amendment to client agreements.

Service availability depends on scheduling, resource allocation, and regulatory conditions. We make commercially reasonable efforts to provide agreed services on schedule but do not accept liability for delays caused by third parties or regulatory processes.

User Rules and Conduct

Users and clients must adhere to professional conduct standards when interacting with myrealtorti staff and systems. The following rules outline prohibited behaviors.

  • Do not submit fraudulent, malicious or illegally obtained information.
  • Do not attempt to access other users' accounts or proprietary systems without authorization.
  • Refrain from abusive or harassing communications with staff or representatives.
  • Do not use our resources to infringe intellectual property or breach confidentiality obligations.
  • Provide complete and accurate information necessary for legal assessments and filings.
  • Comply with applicable laws and regulatory reporting obligations when engaging our services.
  • Respect confidentiality and restricted access designations for documents and communications shared through our platform.

Client Materials and User Content

Client-submitted documents, data, and other materials provided for legal services are considered Client Materials. You remain responsible for the accuracy and lawfulness of these materials.

Ownership of documents and intellectual property you provide remains with you, subject to any contractual terms in your engagement agreement. myrealtorti retains ownership of its pre-existing materials and proprietary methodologies.

By providing Client Materials, you grant myrealtorti a non-exclusive, revocable license to use and process those materials solely to deliver contracted services and comply with legal obligations.

You are responsible for ensuring Client Materials do not infringe third-party rights, contain confidential data without proper authorization, or violate applicable law. We may decline to work with materials that pose a legal risk.

Where applicable, you may request removal of certain user content. Removal subject to retention obligations for legal, regulatory or recordkeeping purposes and any notice periods set out in the engagement agreement.

Intellectual Property

All intellectual property rights in materials, software, templates, reports and processes developed by myrealtorti remain our property unless otherwise agreed in writing. Clients receive only the rights expressly granted in engagement documents.

  • Do not copy or distribute proprietary templates, source code, or methodologies belonging to myrealtorti without authorization.
  • Do not reverse engineer or attempt to replicate proprietary systems or deliverables provided by myrealtorti.
  • Attribution and licensing terms must be respected for any materials shared under limited use licenses in engagement agreements.

Paid Services

Certain legal services, filings and bespoke projects are provided for a fee. Fees and payment terms are specified in engagement letters or service orders.

Pricing is based on scope, complexity and resource requirements. Estimates provided are indicative; final fees are agreed before commencing work. Any significant scope changes may affect pricing.

Payments are due as set out in engagement agreements. We accept agreed bank transfer methods and other payment mechanisms specified in invoices. Timely payment is required to continue services.

Subscription or retainer arrangements, where offered, include the terms for service allocation, renewal periods and billing cycles. Subscription benefits are set out in the relevant subscription agreement.

Refunds or credits are handled on a case-by-case basis consistent with the engagement agreement and applicable law. Where partial services have been delivered, refunds will reflect the proportionate value of services already provided.

Either party may terminate an engagement in accordance with termination clauses. Cancellation may trigger fees for work performed up to the termination date and reasonable wind-down costs.

Clients are responsible for applicable taxes, duties or governmental charges related to fees for services. Invoices will indicate taxes where required by law.

We may revise pricing to reflect changes in regulation, market conditions or cost inputs. Contractual engagements will be managed in accordance with any price change notice provisions contained in client agreements.

Non-payment may result in suspension of services and recovery actions. We may enforce outstanding invoices through lawful collection measures as necessary.

Professional Disclaimer

The materials and information on myrealtorti.digital are for general informational purposes and do not constitute legal advice for specific situations. Engaging our services establishes an attorney-client relationship only when confirmed by an executed engagement agreement.

Limitation of Liability

To the extent permitted by law, myrealtorti's liability for direct damages arising from our services is limited to fees paid for the specific service that gave rise to the claim. We are not liable for indirect, consequential or punitive damages or loss of benefits. Liability limits are subject to mandatory legal provisions in Thailand.

Third-Party Services

We may use third-party providers for specific tasks such as filing, translation or escrow. Use of third parties is subject to contractual safeguards; however, myrealtorti is not responsible for third-party acts beyond our reasonable control.

Termination

Either party may terminate an engagement in accordance with the termination clauses of the engagement agreement. Grounds for immediate termination include material breach, conflict of interest, or legal prohibition on performance.

Upon termination, outstanding fees and costs remain payable. We will return client materials and retain copies as required for professional, legal or regulatory obligations. Transitional support may be provided subject to a separate agreement.

Privacy and Data Protection

Our handling of personal data is governed by the Privacy Policy posted on myrealtorti.digital. We implement administrative and technical safeguards appropriate to the sensitivity of client data and applicable Thai regulations.

Communications

We communicate with clients through secure channels where feasible. Use of standard email carries inherent security risks; confidential or highly sensitive information should be shared through designated secure portals or encrypted methods as agreed.

Amendments to Terms

We may update these Terms from time to time. Material updates will be communicated to active clients and posted on the website with an effective date. Continued use of services constitutes acceptance of revised terms.

Governing Law

These Terms and any disputes arising in connection with them are governed by the laws of the Kingdom of Thailand, without regard to conflict of law rules, to the extent permitted by applicable mandatory law.

Dispute Resolution

Parties will seek to resolve disputes through good faith negotiation and, if needed, mediation. If unresolved, disputes may be submitted to the competent courts of Thailand or other dispute resolution mechanisms agreed in the engagement agreement.
